2021 Tolls BYLAW NO. 110

A bylaw for fixing tolls and other charges payable to the improvement district and the terms of payment thereof.

The Trustees of Sointula Waterworks District ENACT AS FOLLOWS:

The following tolls are hereby fixed and made payable by all owners of land in the improvement district to which water is delivered from the works of the improvement district:

UNMETERED RESIDENTIAL SERVICES

DEFINITIONS:

Dwelling Unit” means one or more habitable rooms, constituting a self-contained unit with kitchen, bathroom, and sleeping facilities, with a separate entrance used or intended to be used as the permanent residence or home of one family.

Suite” means one or more habitable rooms, constituting a self-contained unit with kitchen, bathroom, and sleeping facilities, used or intended to be used as the permanent residence or home of one family, that is in addition to the primary “Dwelling Unit” of the property.

Bed and Breakfast”, “Air B&B”, means a dwelling unit which is operated as advertised or not, to be shared with a small number of transient guests.

ANNUAL USER FEE

Annual Fee (AF) Per Unit (PU) Per month (PM)

The following annual fee shall apply to each residential dwelling, regardless of whether there is a separate water service connection or not, each dwelling unit on same property. $312.00 AF

The following annual fee shall apply to each Room/Suite, B&B, Air B&B, or any other rental accommodation operating within the primary main Dwelling Unit of the residential property. $156.00 AF

The following fees shall apply to each separate dwelling building, cabin, recreation trailer/camper, B&B, Air B&B, or any other accommodation on all residential properties, an annual fee of  $312.00 plus: Sleeping Room $8 PU + PM

UNMETERED COMMERCIAL AND INDUSTRIAL SERVICE FEE

The following fees shall apply to each of the following users, where the fee is not based upon metered amounts of water used.

Retail Store, Restaurants, Coffee Shops, Drinking Establishment, Deli, Bakery, Hotel/Motel, School, Seniors, Post Office, Fish Plant, Fish Company, Harbour, Schools, Laundromat, Shower, and Car wash.

Commercial Fee Examples

Retail Store, Restaurants, Coffee Shops, Drinking Establishment, Deli, or Bakery. CF $636.00 Plus:

Hotel/Motel whether operated separately or in conjunction with any other type of business, for each office or leased unit. CF $636.00 Plus: $8 PU + PM

Hotel/Motel for each sleeping room available for rent, Suite or Apartment CF $636.00 Plus:

Sleeping Room $8 PU + PM

Kitchenette $9 PU + PM

Seniors Citizen Housing Complex for each unit CF $636.00 Plus: $9 PU + PM

Schools for each classroom CF $636.00 Plus: $6 PU + PM

Laundromat, Shower, Car Wash for each unit CF $636.00 Plus: $6 PU + PM

Harbour Authority CF $636.00 Plus: $26 PF + PM

Post Office CF $636.00

Fishing Processing Facility $195 PM

Commercial Fishing Operation with Ice Making capacity of over 10 tons $279 PM

Inspection, Connection, and Turn Water On/Off Fees

  1. Any property owner can request the turn off/on of service by submitting written notice to Sointula Water board Office seven days in advance of the requested service date, except in the case of an emergency, and shall at the same time pay the fee for each request. $50.00 On or Off

  1. Where water connection (standard 18mm (3/4”) is to be installed, a water main lateral line must be within twenty (20) meters distant from the property line. $1075.00

  1. Where water connection is required above the standard 18mm (3/4”) or is beyond the 20 meter standard distance, the fee shall be at cost or a minimum of: $1075.00

  1. Any additional costs are the responsibility of the property owners.

The district has determined that the following are currently exempt of Water Toll charges: Public Health/Medical Centers, Public Museum, Public Seniors Center, Community Church, Public Recreation Association buildings, Public Library, Public Fire Hall, Community Garden Connections.

The owners of premises will have the option of being billed Monthly, Bi-monthly or Yearly. Monthly or by-monthly tolls are due and payable on or before the last day of the month or second month. Tolls paid in full for one calendar year, within thirty (30) days of the billing date, will qualify for a discount of

10 percent (10%) of the total amount payable.

The improvement district may on 24 hours written notice and by trustee resolution order termination of water service to any premises on which there are any tolls or other charges owing for ninety days past the due date. Water shut off under this section will be subject to connection/re-connection fees.

The owner of premises, whether occupied or vacant, to which a service connection has been made shall be responsible for the payment of all water tolls whether water is actually used or not; but the Trustees may by resolution reduce any toll fixed in the preceding clauses in respect of any premises not occupied throughout any period by an amount commensurate with the period the premises are unoccupied, provided the owner or occupant notifies the Trustees in writing as to the time the premises become or are to become unoccupied and the water supply is shut off for the period when the premises are not occupied, subject to the charges levied under this bylaw.

This bylaw repeals Bylaw No.108, Fifteenth Tolls Bylaw, 2020.

This bylaw may be cited as the Bylaw No 110 “Sixteenth Tolls Bylaw, 2021.”
